Official Rules for Camping World Merch Giveaway
No Purchase Necessary. A Purchase Will Not Increase Your Chances of Receiving an Item. Void Where Prohibited.
1. Eligibility: The Camping World Free Merch Giveaway (the "Giveaway") is open to legal residents of the contiguous forty-eight (48) United States (excluding Alaska and Hawaii), who are physically located and residing therein and who are at least eighteen (18) years old at the time of entry (each, an "Entrant"). Employees, officers, and directors of FreedomRoads, LLC, and their respective parent companies, subsidiaries, affiliates, and advertising and promotion agencies (all such individuals and entities referred to collectively, the "Giveaway Entities"), and each of their immediate family members (spouse, parents, siblings, and children) and/or people living in the same household, are not eligible to enter.
2. Entry Period: Each giveaway drop opens at 10:00 AM Central Time on the date announced by Sponsor on campingworldmerch.com and/or through Sponsor communications, and closes when the available inventory for that drop has been claimed or Sponsor otherwise terminates the Giveaway, whichever occurs first. Sponsor reserves the right to schedule, cancel, or modify any drop at any time without prior notice.
3. How to Enter: During the Entry Period, Entrants may enter the Giveaway by visiting campingworldmerch.com and submitting the requested information. Requests are processed on a first-come, first-served basis. Only the first eligible Entrants, up to the quantity available for each item, will receive a free Item. Entries will be deemed to be received when recorded by Sponsor's server. Entrants will be notified electronically. There is a limit of one (1) item per household per rolling thirty (30) day period. "Household" means a single physical address. By entering, you indicate your full agreement to these Official Rules and Sponsor's decisions regarding the Giveaway, which are final and binding.
4. Item: Each eligible Entrant who successfully completes the entry process will receive one (1) free item from the available selection (supplies permitting), which may include apparel (jackets, t-shirts), outdoor gear (such as Solo Stove products), drinkware (water bottles), and similar retail merchandise (each, an "Item"). Specific items and quantities available are listed on the website at the time of the Giveaway and are subject to change. Each Entrant is solely responsible for any applicable federal, state, and local taxes, as well as any other costs and expenses not expressly listed herein. The Item is non-transferable and must be accepted as offered. No cash or other substitution may be requested by an Entrant. Sponsor has no obligation to fulfill any request, and if an Item becomes unavailable for any reason, Sponsor may be unable to fulfill that request and reserves the right to cancel it without notice or liability.
5. Shipping: Free Items will be shipped to the address provided at time of submission, within the contiguous forty-eight (48) United States only. Shipping to Alaska, Hawaii, U.S. territories, APO/FPO addresses, and P.O. boxes is not available. Sponsor is not responsible for Items lost, delayed, or undeliverable due to incorrect or incomplete address information provided by the Entrant.
6. Fraud & Cancellation: Sponsor reserves the right to cancel any request that it determines, in its sole discretion, to be fraudulent, suspicious, or otherwise in violation of these Official Rules. This includes, but is not limited to, requests involving false or incomplete information, automated submissions, bulk requests, or any attempt to circumvent the household or eligibility limits. Duplicate requests from the same address, name, email address, or any other indicator of the same household within the same 30-day period will be canceled without notice. Individuals who submit fraudulent requests may be permanently disqualified from future Giveaways.
7. General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway; or (b) cancel the Giveaway and fulfill no further requests. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Giveaway, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Giveaway is subject to federal, state, and local laws and regulations and is void where prohibited.
8. Release and Limitations of Liability: By participating in the Giveaway, you agree to indemnify, defend and hold harmless FreedomRoads, LLC, CWGS Group, LLC, and their respective parent companies, subsidiaries, affiliates, and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Giveaway, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors that may impair your ability to participate in the Giveaway; (c) errors in the administration of the Giveaway arising from circumstances beyond our reasonable control; and (d) claims relating to injuries, death, or damage to persons or property relating in any way to your participation in the Giveaway or receipt of an Item.
9. Privacy: Any information you submit as part of the Giveaway will be used for purposes of this Giveaway and treated in accordance with our Privacy Policy, available at https://www.campingworld.com/helpcenter-ourpolicies/privacyPolicy.html.
10. Disputes: To the fullest extent permissible by law, with the exception of disputes pertaining to intellectual property rights, actions seeking public injunctive remedies and certain statutory claims that, pursuant to law, are not arbitrable, any dispute of any kind between you and us including, without limitation, claims arising under these Official Rules or your participation in the Giveaway (a "Dispute") shall be resolved through binding arbitration pursuant to these exclusive dispute resolution procedures, except that either party may assert claims in small claims court or seek action through government agencies.
These Official Rules will be governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. You agree that resolution of any dispute or claim arising out of or related to these Official Rules shall be subject to the exclusive jurisdiction and venue in the state and federal courts in Lake County, Illinois.
If you or we believe you or we have a Dispute or claim against the other arising out of your participation in the Giveaway or under these Official Rules, you and we agree to first discuss the matter informally with the other for at least 30 days. To do that, you must give us written notice, which will include your full name and contact information, the nature and basis giving rise to your Dispute or claim and your proposed resolution, sent to the Notice Address below, Attn: Legal Department. We will send written notice to you via certified mail to the most recent address we have on file for you (or by email if we only have an email address for you on file).
If we are unable to resolve your or our concerns informally within 30 days after receipt of the written notice, you or we may file a claim in small claims court so long as the party seeking relief proceeds only on an individual basis or commence an arbitration proceeding, which means YOU AND WE ARE AGREEING TO WAIVE OUR RIGHT TO SUE IN COURT, HAVE A JURY TRIAL AND LEAD OR PARTICIPATE IN A CLASS ACTION. You and we agree that any and all disputes or claims that have arisen or may arise between you and us in connection with the Giveaway and your participation in the Giveaway shall be resolved exclusively through small claims court or confidential, final, and binding arbitration. The arbitration will be conducted by JAMS under the JAMS Comprehensive Arbitration Rules & Procedures (available at https://www.jamsadr.com/rules-comprehensive-arbitration/) and, if 10 or more similar claims are filed, the JAMS Mass Arbitration Procedures and Guidelines (available at https://www.jamsadr.com/mass-arbitration-procedures). For the avoidance of doubt, you agree that YOU MAY ONLY BRING CLAIMS AGAINST SPONSOR IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER OR IN ANY REPRESENTATIVE CAPACITY OR PROCEEDING. Unless the JAMS Mass Arbitration Procedures and Guidelines are triggered, you agree that no arbitrator shall consolidate any other person's claims with your claims and may not otherwise preside over any form of a multi-party or class proceeding. You agree that the award of the arbitrator will be binding and may be entered as a judgment in any court of competent jurisdiction in the State of Illinois. You agree that we may seek interim or preliminary relief from a court of competent jurisdiction in Illinois, necessary to protect its rights or property pending the completion of arbitration.
Exclusions from Arbitration/Right to Opt-Out: Notwithstanding the above, you may choose to pursue a Dispute in court and not by arbitration if YOU OPT-OUT OF THESE ARBITRATION PROCEDURES WITHIN 30 DAYS FROM THE DATE THAT YOU FIRST CONSENT TO THESE OFFICIAL RULES (the "Opt-Out Deadline"). You may opt out of this Provision by mailing written notification to us via the Notice Address below. Your written notification must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes with Sponsor through arbitration. Your decision to opt-out of this Arbitration Provision will have no adverse effect on your relationship with Sponsor. In the event that you opt-out consistent with the procedures set forth above, all other terms of these Official Rules shall continue to apply. Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Dispute in arbitration.
You must file a demand for arbitration with JAMS within ONE (1) YEAR after the date your claim arose, or within the shortest time period permitted by applicable law. Otherwise, your claim is waived.
